BLU Fitness does not provide medical diagnosis, medical treatment, physical therapy, or medical nutrition therapy.
Participation in exercise involves inherent risks, including but not limited to muscle soreness, strains, sprains, falls, equipment-related injuries, cardiovascular events, and other injuries.

7. Hybrid Coaching
Hybrid Coaching combines online coaching with scheduled in-person training.
Certain Hybrid plans require a 3-month or 6-month commitment, which will be clearly identified before purchase.
The applicable commitment begins on the client's enrollment/start date.
By purchasing a committed Hybrid plan, the client agrees to remain enrolled and financially responsible for the selected term, subject to any cancellation rights required by applicable law.
In-person sessions are subject to scheduling and trainer availability.
8. In-Person Training
BLU Fitness does not currently operate from a permanent dedicated gym facility.
In-person training may take place at approved partner facilities, commercial gyms, community facilities, outdoor locations, residential/private training locations when appropriate, or other mutually agreed-upon locations.
Training locations may change based on availability, safety, weather, facility policies, client needs, or the type of service purchased.
Clients are responsible for following the rules and policies of any third-party facility used for training.
9. Equipment
Clients do not necessarily need access to a commercial gym.
BLU Fitness may design programs around the equipment available to the client, including bodyweight, dumbbells, resistance bands, kettlebells, machines, or other equipment.
Clients are responsible for using equipment properly and maintaining a reasonably safe training environment.
10. Nutrition Coaching
Nutrition Coaching is intended to provide general nutrition education, planning support, accountability, and practical guidance.
Nutrition Coaching is not medical nutrition therapy and does not replace a registered dietitian, physician, or other qualified healthcare professional.
Clients are responsible for disclosing known food allergies, intolerances, dietary restrictions, and relevant preferences.
Clients with medical conditions or specialized dietary requirements should seek appropriate professional guidance.
11. Scheduling & Attendance
In-person sessions must be scheduled in advance.
Clients should provide as much notice as reasonably possible when they need to cancel or reschedule.
A session may be considered used when a client:
- Does not attend;
- Cancels without sufficient notice;
- Arrives excessively late; or
- Fails to communicate a scheduling conflict.
BLU Fitness may make reasonable exceptions for emergencies or circumstances outside the client's control.
Unused sessions do not automatically roll over into a subsequent billing period unless specifically stated in the client's plan.
12. Client Responsibilities
Clients agree to:
- Provide accurate information.
- Complete required onboarding forms.
- Disclose relevant injuries and limitations.
- Follow reasonable coaching instructions.
- Participate consistently.

Response times may occasionally be longer during weekends, holidays, high-volume periods, or circumstances affecting availability.
BLU Fitness messaging should not be used for medical emergencies.
14. Fees & Payments
Clients agree to pay the price displayed for the service selected at the time of purchase.
Payment may be processed through BLU Fitness's third-party payment provider.
Clients are responsible for maintaining a valid payment method.
If a payment fails, BLU Fitness may suspend access to services until the account is brought current.
15. Monthly Recurring Plans
Monthly coaching plans are recurring services.
Unless otherwise stated at checkout, the plan will continue to renew according to the billing frequency displayed during enrollment until cancelled.
Before purchase, clients will be provided with the applicable:
- Price
- Billing frequency
- Services included
- Minimum commitment, if applicable
- Renewal terms
- Cancellation policy
By completing the purchase, the client authorizes the applicable recurring charges.
BLU Fitness will provide purchase or confirmation information that includes applicable billing and cancellation information.
16. Cancellation
Month-to-month clients may cancel their recurring service using the cancellation method provided by BLU Fitness.
Cancellation should be completed before the next scheduled billing date to prevent the next recurring charge.
Cancellation stops future charges but does not automatically reverse payments that have already been processed.
For 3-month and 6-month commitments, cancellation is subject to the applicable commitment terms and any cancellation rights required by law.
BLU Fitness will not intentionally make the cancellation process unnecessarily difficult.
17. Pausing Services
Clients may request a temporary pause depending on their plan and circumstances.
A pause is not automatically guaranteed.
If a pause is approved, BLU Fitness will confirm the applicable pause period, billing treatment, and restart date.
A pause does not automatically cancel a client's contractual commitment.
18. Refund Policy
Because BLU Fitness services may involve personalized programming, coaching preparation, reserved training time, digital resources, administrative work, and other services delivered specifically for the client, payments are generally non-refundable once services have been delivered or a coaching period has begun, except where otherwise required by applicable law or expressly approved by BLU Fitness.

- Reason for the request
BLU Fitness will review requests individually when circumstances may justify an exception.
If approved, refunds will generally be issued to the original payment method.
Processing times may vary depending on the payment processor or financial institution.
20. Payment Disputes
Clients are encouraged to contact BLU Fitness regarding billing concerns before initiating a payment dispute so that the issue can be investigated and resolved when appropriate.
Nothing in this section prevents a client from exercising rights available under applicable law.
A payment dispute does not automatically cancel a contractual commitment or eliminate amounts properly owed under an applicable agreement.
21. Digital Platforms & Technology
BLU Fitness may use third-party platforms, applications, payment processors, communication systems, and other technology to provide services.
BLU Fitness does not guarantee uninterrupted access to third-party technology.
Temporary outages, maintenance, technical issues, or third-party service interruptions may occur.
BLU Fitness will make reasonable efforts to restore access or provide an appropriate alternative when practical.
22. Intellectual Property
BLU Fitness owns or has appropriate rights to its original programming, educational materials, videos, graphics, written content, branding, logos, templates, systems, and other proprietary materials unless otherwise stated.

23. Client Photos, Testimonials & Marketing
BLU Fitness will not intentionally use identifiable client photographs, transformation photos, testimonials, or success stories for public marketing without appropriate permission.
Clients may separately choose whether to provide permission for marketing, testimonials, transformation stories, social media content, or promotional materials.
Declining marketing permission will not prevent a client from receiving coaching services.

By participating in BLU Fitness services, the client acknowledges that exercise may involve risks of injury or other adverse outcomes.
Clients agree to use reasonable care, follow applicable coaching instructions, and stop an activity when they experience concerning symptoms.
Clients should seek appropriate medical assistance when necessary.
27. Limitation of Liability
To the maximum extent permitted by applicable law, BLU Fitness, its owner, coaches, contractors, and representatives will not be responsible for indirect, incidental, consequential, or special damages arising from participation in BLU Fitness services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
28. Force Majeure
BLU Fitness will not be responsible for delays or interruptions caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government actions, public emergencies, facility closures, power outages, technology failures, or other extraordinary circumstances.

Material changes to recurring-service terms, including material changes to price or renewal terms, will be communicated as required by applicable law.
